Conditional Fee Agreements are commonly referred to as “No Win No Fee” Agreements. They are historically the most popular way of funding personal injury claims. Your solicitor agrees not to take a fee if your claim is unsuccessful, but then charges a success fee on top of their basic costs if you win your claim. Your basic costs are ordinarily payable by your opponent. The success fee element is deducted from the compensation monies. Any deduction in respect of the success fee is capped at 25% of the value of the injury aspect of your claim ("general damages").
